V&S EXPECTED TO LOSE “FALSE” TRADEMARK
Based on an article in Just-Drinks last week, WSD reported that Vin & Sprit planned to appeal a decision by a Swedish court over its rights to the Golden Gate wine brand, currently owned by The Wine Group.
According to further reports by Just-Drinks, the appeal has gone through but is expected to fail.
Last week, a court in Sweden ruled that V&S had infringed the trademark rights for the Golden Gate brand, claiming they had secured permission from Golden Gate Vintners in 1998 to use the brand name before it was bought by Wine Group.
The Wine Group, however, maintains that V&S does not have a case after falsely registering the Golden Gate trademark, and breaking its supply agreement with Golden State Vintners.
Under the agreement, V&S could use the Golden Gate brand in exchange for V&S bottling the brand exclusively with GSV supplied wines. According to The Wine Group, V&S did not honor the deal, and instead secretly registered the trademark in Sweden.
The Wine Group remains confident that the appeal will end in their favor.
