MAINE UPHOLDS THREE-TIER SYSTEM

The U.S. District Court in Maine upheld a ruling yesterday on the side of wholesalers by rejecting an appeal from wineries to allow direct shipping. The court ruled to maintain the state’s current regulatory system, which requires the use of wholesalers and outlaws any direct wine shipments to consumers.

In a statement, the WSWA (Wine & Spirits Wholesalers of America) president and chief Craig Wolf applauded the court for upholding “the state’s right to regulate alcohol.”

In July of 2006, U.S. Magistrate Judge Margaret J. Kravchuk published the following statement in regards to upholding the three-tier system in Maine:

Maine’s current law “simply does not impose any cognizable burden on interstate commerce that could possibly outweigh the putative local benefit of regulating minors’ access to alcohol.”

“Mail order transactions cannot reliably be policed in order to protect certain minors from themselves.”
