ILLINOIS EXTENDS DIRECT SHIPPING DEADLINE
In the Illinois House last week, state Bill 429 failed to get a vote and the deadline was extended to May 18.
This bill will, if passed, move Illinois from a wine reciprocal state to a direct shipping state for a limited gallonage both to retailers and consumers. In-state retailers will also retain the right to ship directly to consumers.
The final version of the bill has a provision in it that specifically prohibits out-of-state retailers to ship directly to consumers, rejecting an amendment backed by the Specialty Wine Retailers Association (SWRA). The SWRA has threatened to sue the state of Illinois if it passes Bill 429 with the provision preventing out-of-state wine retailers to ship direct.
Their argument is that forbidding out-of-state retailers from shipping directly to consumers when in-state retailers are allowed to do so is in violation of the Commerce Clause.
